A Denver Divorce Mediator is a better choice

What is Divorce Mediation?

Divorce Mediation is a process of working with a neutral Denver Divorce Mediator professional to achieve fair and reasonable outcomes that both sides find fair and reasonable. It is an alternative to lawyer led disputes and Court ordered outcomes that leave one, or in many cases, both sides unhappy with the results.

How does Mediation generally work?

Generally, Mediations tend to follow this simple order:

  1. Disclosures (Financials and underlying concerns/intentions)
  2. Negotiation and Solution Building
  3. Documentation/Filing with the Colorado Court.

Depending on the type of case you have and the characteristics of your specific circumstances the Mediator may expand or streamline different steps as appropriate.

During the Mediation the Mediator will set the agenda based on the topics you wish to resolve, and facilitate the communications and negotiations so details are discussed and considered and the process remains productive and respectful. The Mediator will encourage you each to share your reasons for your requests and identify potential areas where clients issues can be mutualized and a common solution could satisfy both Parties.

Once an agreement is reached, the Mediator can document the terms and details of your agreement in either a term sheet called a Memorandum of Understanding, or if both Parties agree, the Mediator can assist with reducing the Parties agreements to writing in the forms you can file with any County Court in Colorado.

During the whole process the Mediator focuses on the issues and pragmatic solutions and does not give the Parties legal advice and does not have the authority to compel the Parties to any action. In short, the Parties determine the Outcome and the Mediator determines how they get there.

What Makes Mediation Different?

The Objective

The Objective is to identify and create solutions that work for Both Parties which decrease the overall hours spent and results in solutions acceptable to both sides.

The Mediator

Instead of each party paying an expensive Lawyer, you each pay half of one lower cost Mediator. The cost savings  can really be evident in High Conflict cases where the hours mount quick and high. Mediation leaves the Parties with more of their money to start the next chapter in their lives.

The Confidentiality

Details of issues and resolutions can be kept private to the mediation and are not disclosed to outside parties like the other Party’s Lawyer.

It's Voluntary

You can terminate the Mediation at any time. If Mediation doesn’t work, you are not held liable to agreements discussed during the Mediation. You don’t have to agree to terms you don’t want to.

Level of Legal Support

You can work with Mediation Pro Se or without Attorneys, You can have Attorneys off to the side, or you can have Attorneys attend the Mediation. You decide.

Quick Decision Making

Since the Parties control the outcome, they can quickly agree to negotiated terms much faster than if mired in Court Hearings and legal posturing from the Attorneys. Courts will accept negotiated agreements so this cuts down timeframes dramatically.

How Long Does Divorce Mediation Generally Take?

Depending on the type of case you have and whether or not there are any complicating factors the entire duration of a mediation can be estimated by the case time over the past 17 years as below. Summary of overall calendar durations of Mediations.

  1. Divorce with Children 6-8 weeks
  2. Divorce without Children 3-5 weeks
  3. Establishing a Parenting Plan 1-2 weeks
  4. Modifying Child Support 1 week
  5. Modifying a Parenting Plan 1-2 weeks
  6. Negotiating Marital Agreements 2-3 weeks

What does Divorce Mediation generally cost?

Your type of case and the complicating factors will directly impact your overall cost of the mediation. Divorces with Children where there is high conflict will take longer obviously than Divorces where the kids are a lot older and the Parties are amicable. The following averages however can be used as a starting place.

  1. Divorce with Children start around $950 each
  2. Divorce without Children start around $600 each
  3. Establishing a Parenting Plan start around $500 each
  4. Modifying a Parenting Plan start around $400 each
  5. Modifying/Terminating Child Support start around $250 each
  6. Modifying/Terminating Spousal Maintenance or Alimony start around $250 each
  7. Post Decree Mediations start around $275 each

Whatever the cost I am pretty confident in saying that we are the more affordable and offer a better value than other established Mediation offices and Law Offices and if you do have complicating factors the cost with other more expensive firms will go up even more and leave us still as the more value rich option.
