Episode Overview:
In this episode, we dive into a powerful mediation approach called Shuttle Mediation, which can be invaluable for high-conflict or no-contact cases. We’ll break down what Shuttle Mediation is, how it operates, and when it’s most effective. I’ll also share a challenging case where this method allowed two parties who could not communicate directly to reach a solution in just one day.


What is Shuttle Mediation?

  • Definition: Shuttle Mediation is a process where the parties are kept in separate rooms, with the mediator moving between them. The mediator’s role is to facilitate the negotiation, not merely to pass messages.
  • Mediator’s Role: The mediator focuses on constructive communication, omitting negative elements and conveying the positives to maintain progress. They draw on their understanding of each party’s interests and concerns to present viable options.
  • Benefits and Risks: This process allows parties who cannot interact directly to negotiate, but it requires a skilled mediator to prevent bias or miscommunication. It can lead to successful outcomes when other methods aren’t viable.

How to Utilize Shuttle Mediation

  • In-Person or Virtual: Shuttle Mediation can occur in person with separate rooms or virtually using breakout rooms.
  • Expectations:
    • Mediator will visit each party, but wait times may vary.
    • For virtual sessions, no one should be listening or nearby off-camera.
  • Practical Tips:
    • Know Your Space: Get information on bathroom and kitchen locations, door codes, WiFi access, and contact info for office support.
    • Bring Essentials: Snacks, court paperwork, notebooks, a distraction like reading material, and headphones for any devices.
    • What Not to Bring: Avoid bringing children, family members (unless cleared), and full meals.
  • Maximizing Waiting Time: If the mediator hasn’t assigned tasks, use the time to brainstorm solutions, evaluate goals, consider BATNA/WATNA/ZOPA (Best/Worst Alternative to a Negotiated Agreement and Zone of Possible Agreement), consult your attorney, and engage in calming activities like breathing exercises or journaling.

When is Shuttle Mediation Used?

  • Shuttle Mediation is ideal when joint sessions are not an option, such as in:
    • High Conflict cases
    • Safety Concerns: Previous or potential physical threats, restraining orders, or when one party feels unsafe.
    • Restraining Orders: Requires court permission, staggered arrival/departure times, and coordination with the mediator.

Special Considerations

  • Legal and Safety Protocols:
    • Attorneys can join in-person, virtually, or via phone during mediation.
    • Any safety concerns (physical, emotional, or post-mediation retaliation) should be communicated to the mediator, especially in cases involving children’s safety.
  • Mediator Proposal: In some cases, the mediator may propose a confidential agreement option to resolve specific points.

Real-World Example

In this episode, I share a case where communication was impossible, and Shuttle Mediation allowed both parties to work toward an agreement in just one day. Despite the challenging circumstances, Shuttle Mediation enabled both parties to access the benefits of mediation without direct contact.
